Hi All,
Please help!!
I will be completing my first 3yrs of H1 in Sept 2010. My I-797 is valid till Sept 2010. I-94 & H1 visa expired on April 4th 2010.
My company has applied for 1-129 on April 1st 2010.
I have a few questions -
1. Since my 1-94 is expired and H1 too, am "I out of status"? - I-129 is still pending, I have received the receipt from USCIS on April 12, 2010.
2. If I am out of status, is it going to effect my visa renewal or H1 extensio?
3. What to do?
Your response will be highly appreciated, I am very confused.
Thanks & Regards.

Immigration Visa Attorney Blog Has Just Posted the Following:
The attorneys at Fong & Chun, LLP have helped hundreds of legal immigrants seek citizenship over the years. Whether we have worked with you at a naturalization drive, through labor unions, or in our own offices, citizenship is the ultimate goal of most immigrants. Today, the government announced (http://articles.latimes.com/2010/aug/22/local/la-me-refugee-assistance-20100823) that cash assistance to elderly and disabled immigrants who were granted entry based on humanitarian reasons may lose benefits unless they have naturalization applications pending. Many of those affected are people who were granted asylum or refugee status.
Most immigrants are eligible for naturalization after a 3 or 5 year period after their initial residency period begins. Many immigrants delay applying for naturalization because they fear the English or history exams. While the naturalization exam can seem daunting, the government allows for applicants to re-take their exams if they fail the first time. Some immigrants who are long term residents may even take the examination in their native language, but many immigrants simply put off the naturalization process because it has become intimidating or costly. However, in most cases, an immigrant who truly desires to naturalize and is eligible to do so can make an application and be successful with the right type of support and preparation. Today's announcement by the administration poses yet another reason for immigrants who have been putting off their citizenship application to call and find a qualified immigration attorney (http://www.fongandchun.com/lawyer-attorney-1416111.html) to help them with the process. Fong & Chun encourages those eligible for naturalization make an application and realize their dreams of finally becoming US citizens. ---ecf

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.

This item deals with "Wage per week " in this field after i checked out my application lawyer gave the whole years income instead of weeks income. as i enquired he said even though "/year" is ideal to mention immigration officers know that this amount is same as that of Labor and thats not an issue . any comments please?

Hi..I was in a similar situation. Best thing for you to do is File for F2. Make sure you send dependent I-20 issued from your wife's school with your F2 application. Pay slips are only needed for changing status from H1 to F2, in your situation. No payslips are needed when you change status back to H1, because you are on F2 at that time. hope this helps.good luck.

USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...

Nice composition. Lighting seems a little flat/dead and it needs a little more sky detail. Did a minor bit of processing to see if I could make it better. See what you think.

Hello
Thank you for your time and I appreciate your effort.
Scenario:
I have two Approved I-140s (both filed by same company).
 Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?

I think you should wait until you get your new approved EAD.
How come the company who is taking you didn't ask for unexpired EAD???

I have already sent my 485 application
1-140 cleared
In the field I94# and expiration I entered I 94 number which is on the white card on the passport and it is the same as the number on my renewed h1 papers. However I entered expiry date from the i94 on the passport, which is oct06 instead of the 010 date in the renewal.
will that be a problem..? CAN I CORRECT IT AFTER I get the reciept no or will thay be able to verify with the latest h1 paper that i94 is valid
The I94 number is in the database. When I94 was extended that information is entered in the database as well.

Hi,
Need advice from an attorney:
My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?
2. Is there a source on the Net that I can refer to that explains this?
Thanks,
AjaySri
If you are maintaining H-1B status, you can file for status extension and will get new I-94.
If you are using EAD and have I-485 pending "status" then I-94 extension is not necessary.
