    Street protests spread across India this week after a court handed down a life sentence to a prominent activist and physician who has long drawn attention to the country's growing economic inequalities.

    In a case that has prompted denunciations by international human rights groups and scholars, prosecutors said Binayak Sen, 60, had aided Maoist rebels in rural India, visiting Maoist leaders in jail and opening a bank account for a Maoist, charges that Sen denies. Human rights activists allege that police planted evidence and manufactured testimonies, and Indian judges have criticized the Dec. 24 judgment.

    Soli Sorabjee, a former attorney general, called the ruling "shocking."

    "Binayak Sen has a fine record," he said. "The evidence against him seems flimsy. The judge has misapplied the section. And in any case, the sentence is atrocious, savage."

    Sen, a pediatrician, has worked for decades to help people displaced by violence and government land seizures in India's mineral-rich regions. Despite the country's booming economy, hundreds of millions of Indians remain mired in poverty - a stubborn inequality that has helped fuel a deadly Maoist insurgency in as many as 20 of India's 28 states.

    The ragtag Maoist rebels, called Naxalites after Naxalbari, a village in West Bengal state where the movement was born in 1967, seek to gain power through armed struggle. They claim to fight for the poor and India's marginalized tribal groups but have also been accused of widespread atrocities. Prime Minister Manmohan Singh has called the Naxal movement the "biggest single threat to India's internal security."

    Sen, who was arrested in 2007 and was not granted bail for two years, says he was targeted solely because he was a vocal critic of the government's use of armed groups to push villagers out of mineral-rich forest areas. His sentencing comes as major economies, including the United States and China, are seeking access to India's growing markets - a sign of the country's emergence as an economic superpower.

    "Anyone in India who dissents or questions the superpower script is ostracized," said Kavita Srivastava, national secretary of the People's Union for Civil Liberties, of which Sen is a vice president. "Sen's arrest is happening because this government is extremely anti-poor. Our much-praised 9 percent growth is coming at the cost of displacing millions of people with land that is being given away for mining and corporate development."

    Sen's difficulties with Indian authorities have drawn global attention before. In 2008, an effort led by 22 Nobel laureates failed to secure Sen's release on bail so he could travel to Washington to receive the prestigious Jonathan Mann Award for his efforts to reduce the infant mortality rate and deaths from diarrhea.

    This time, protests erupted after a court in the eastern state of Chhattisgarh convicted Sen on two counts of sedition and conspiracy, sentencing him to life imprisonment. He was found not guilty of a third charge of waging war against the state, a crime punishable by death.

    A growing number of Indian intellectuals and human rights activists have spoken out on his behalf this week.

    "Binayak Sen has never fired a gun. He probably does not know how to hold one," historian Ramachandra Guha wrote in the Hindustan Times. "He has explicitly condemned Maoist violence, and even said of the armed revolutionaries that theirs is an invalid and unsustainable movement. His conviction will and should be challenged."

    Sen's wife, also a doctor, said in an interview that she is launching an international campaign to do just that.

    "He is a person who has worked for the poor of the country for 30 years," Ilina Sen said. "If that person is found guilty of sedition activities when gangsters and scamsters are walking free, well, that's a disgrace to our democracy."

    I only read a few posts, but seems like there a lot of moral blasting and blame game going on.

    I am in favor of fair practices, and on that principle everyone has right to speak their mind; irrespective of outcome of this thread, why is everyone fighting with each other ? We are here because of some common cause, and even though we have a common cause, all causes are not common.

    I agree with you Rolling_Flood, this porting option can and actually has created trouble for many people who did not have a way to port priority dates. This is same issuse as "Labor substitution", I am glad labor substitution has been put to rest.

    Rolling_flood, donot get annoyed or angry because of some comments ( everyone has a right to speak as you do). remember the saying " if you have a few enemies; that means you stood up for something some day".

    We should talk to the campaign officials of both Obama and John McCain. We should clearly articulate our case and lead this effort more vigorously with whoever that wins the election.

    Here is my Point if we educated legal immigrant community support Barack or John ( though its a virtual support because we are not eligible to vote:))

    If Barack doesn't win this 08 election economy is going to go further down , unemployment rates will spike , DOW will further nose dive , more banks will be bankrupt ( today morning WAMU broke 9/26/08) and there will be NO EMPLOYMENT BASED REFORM in such a Turbulent Job Market Situation.

    Anti Immigrant Groups will scorch the phone lines and will probably gather support from neutral peoples as well and scuttle any EB REFORM if the economy is bad. Their point is Americans are Jobless and you are giving Permanent Job Permit to Foreigners and any one will buy it - how much we SCREAM and SHOUT that we already have a Job, you know !

    A guy who filed his labor in say 2001 and it took 3 years for that labor to approve should he complain that after PERM guys got labor approved in 2-3 months and in some cased even before him. Should we complain USCIS / DOL for improving the system? Guys just because your Lawyers asked you to file EB3 does not make things right. Why did you agree on EB3? if you were so convinced that you qualified for EB2 you could have taken the matters to your boss and upper management in your company? If you did not get juistice then you could have quit that company and joined another organization that was ready to recognize your talents? All phani_6 wants is a cake and eat it too. This is not possible dude this letter in its present draft is a laughing stock. Make it factually correct and this will make entire IV community support it regarless of Eb2 or Eb3.

    I agree with your comment. I read through various posting and rational behind that. This EB2/EB3 stuff has revived memories of worst times. And clearly I remember two other unofficial catagories.

    Delayed: I see people at least got EB3 catagory. Several people were delayed by employer for couple of years and then by lawyers (I am one of victim).

    Returned: Several guys returned back, they could have easily been in various EBs catagories.

    Do you guys think delayed and returned should also rise up in addition to EB3? Or let these groups be perished in times.

    Tightening employment restrictions will bring more accountability to government, contends Rep. Henry A. Waxman (D-Calif.), chairman of the House Oversight and Government Reform Committee. Recent lobbying and procurement scandals are proof that something needs to be done, he points out.

    Congress has been trying to regulate the revolving door -- the rotation of federal officials and business executives into and out of government -- since at least 1872, according to the Congressional Research Service.

    Over the decades, Congress has sought to protect the government from former employees who took sensitive information with them and used it to promote the interests of a private party. Congress also has devised rules to discourage federal employees from cashing in on their inside knowledge or becoming snarled in conflicts of interest with companies doing business with the government.

    The institute, which alone spent $17.8 million in the second half of 2006, does all manner of lobbying and research to fight trial lawyers. The rest of the Chamber buys issue advertising and houses a stable of lobbyists and policy analysts.

    By contrast, the National Association of Manufacturers -- the Chamber's onetime rival -- spent just $3.6 million in the second half of 2006, down dramatically from $9.6 million in the year's first six months. NAM said the 63 percent decline resulted from its withdrawal from lobbying on the asbestos bill that it wanted but failed to get.

    NAM was outpaced in lobbying expenditures in last year's second half by a wide range of groups and individual companies. Twenty of these spent more than $5 million during the period.

    This guy is just after his ratings nothing else...his book explicitly quotes that H1b and L1 visa holders do not pay any taxes and transfer all the money home. (CNN has a few hundreds of them on H1b)

    When there was a huge debate on illegal immigration he quoted he was all for legal immigration. The only way one can legally immigrate with skills is via H1b visa and he is against it.

    When the debate is on illegal immigration, the former immigrants and their descendants will chant "We love legal immigrants". When the focus shifts to legal immigration, suddenly they don't want any immigration. Their argument is "If bus is full , we don't need more passengers" . Likewise USA is "full" with former immigrants and their descendants , so don't need more immigration.
    If supply is squeezed somehow, the demand will increase. But poor fellows, if businesses can't get qualified numbers , it will accelerate outsourcing.

    What are we trying to achieve through this thread? (And please don't get offended by this question. )

    a) Educate people
    b) Organize a phone campaign for a week (or longer) for Durbin's office asking him to
    1) Either kill the bill altogether (Kill Bill)
    2) OR make a distinction between existing H1s and new H1s. (If the law applies to new H1s, then we should not care.)

    Why is senator Durbin insisting upon providing American trained (and in some cases, even American educated) high-skilled individuals to low-cost competitors of America (India and China)?

    I agree with you that the ability to file for 485 without a visa number would be a blessing for all of us.

    What are we doing about this situation btw?

    Can't Lou be sued for intentionally having false information in his book. At lease we should all add negative comments about his book on Amazon.com reviews. His book rating on Amazon is 4 and we should add 30-40 comments to bring the rating to at least 2-3 star.

    Sorry , you can't hide your passive aggressiveness :)
    AS I mentioned on other occasions this whole process is screwed up. it gets you worked up when some one compares this (PD recapture) to labor selling. IT IS NOT.

    To answer what does one get by comparing the job duties : It gives a lot. It gives EB2 classification only to those who deserve it. I wish the rules are much stricter.So that those who can claim they are EB2 are really entitled to be EB2.

    There is so much dirty laundry and not good to bring that in public. But if this law suite goes , it does not take very long to show how genuine some EB2s are.

    I agree, I am no saint, i have my shortcomings; actually more than i would like.
    My point is please listen to others folks, and be nice.
    We really cant get anything done hereby arguing.

    For a one-party state that tolerates practically no open defiance of its authority, Beijing�s gentle handling of hundreds of striking truckers in Shanghai who had paralyzed operations at one of China�s largest container ports seems an anomaly. Instead of sending in riot police to break up the blockade last week, the authorities in Shanghai agreed to reduce fees levied on the truckers, who were angry over the charges and rising fuel prices.

    The outcome of this incident couldn�t be more different from another recent event: the arrest of Ai Weiwei, one of China�s most prominent political activists. Ai has repeatedly defied the ruling Communist Party and, despite his international stature, Beijing decided to put him behind bars, ignoring widespread international condemnation.

    The contrast between these two incidents raises an intriguing question: why does Beijing tolerate certain forms of protest, but represses others?

    One obvious reason is that it depends on the nature of the protest. As a rule, a frontal challenge to the authority of the Chinese Communist Party, as Ai�s activities embodied, practically guarantees a harsh response from the government. But protest inspired by specific economic grievances, such as truckers� ire over excessive fees, seems to fare better. In the eyes of the ruling party, the former constitutes an existential threat and so no concessions are seen as able to appease political activists rejecting the very legitimacy of the regime.

    In contrast, the discontent generated by well-defined economic grievances can be treated with specific concessions. One quote, allegedly from a sitting senior Politburo member, says it all: �What are the contradictions among the people?� the Politburo member supposedly asked. �(These contradictions) can all be solved by using renminbi.�

    But things are a little more complicated than this. The reality is that even when dealing with protests or riots fuelled by specific socioeconomic grievances, the behavior of the Chinese authorities isn�t always consistent. Sometimes, government officials pacify protesters through the use of the renminbi, while other times they mercilessly crush such protest.

    So how do we make sense of such apparent inconsistencies?

    It seems that the type of response to social protest�harsh or soft�depends on a complex mix of factors such as who the protesters are, the resources and organizational capacity at their disposal, the economic sectors in which they are located, and the social repercussions of their protest. Generally speaking, highly organized protesters (such as truck drivers, discharged soldiers and officers of the People�s Liberation Army, and taxi drivers) tend to fare better. They also possess resources that can be easily and effectively deployed. Taxi and truck drivers, for example, can use their vehicles to paralyze traffic and produce instantaneous and widespread social and economic disruptions.

    Former PLA servicemen, meanwhile, have a strong institutional identity and are well-connected with each other through ties forged during their military service. Research conducted by Chinese scholars shows that protests organized by former PLA servicemen tend to get the most attention�and the softest treatment�from the government. In contrast, protests by peasants are handled more harshly as they are less organized, possess few strategic assets, and have little impact beyond their villages.

    Another important factor is the political calculations of local officials. Despite the popular image of the Chinese state as a hierarchical, top-down system, there�s no uniform national manual for handling protests. This leaves a great deal of discretion at the hands of local officials, but it also places them in a political quandary. Whenever a mass protest erupts, local officials have to think and react fast, but deploying riot police and using force against protesters isn�t necessarily the preferred modus operandi since this could prompt an escalation in violence. Local officials who mishandle mass protests risk demotion or even dismissal, so they must calculate how to end such demonstrations peacefully and quickly, while ensuring that their actions won�t also encourage future protests. It�s a difficult balancing act.

    So what influences the political calculations of local officials?

    As I�ve said, it�s in large part the nature of the protest, the strength of the protesters, and the likely effects of the protest�all are critical variables. Local officials usually avoid using violence against protests inspired by economic discontent and organized by workers in strategic sectors (transportation and energy, for example). Another factor at play is simply the amount of renminbi available to local officials for buying off the protesters. In the case of striking truckers, the Shanghai municipal government, the wealthiest local jurisdiction in China, has plenty of money. But in poorer areas, the renminbi option just doesn�t exist.

    Another factor is media glare�the more media coverage (particularly international media coverage), the more constraints on local officials� use of force. Last, the location of the protest is key. When such protests happen in remote villages or towns, they are quickly and ruthlessly crushed. But when they occur in urban centres, the government (usually) responds more cautiously and gently.

    All this means that the happy ending for the striking truckers in Shanghai shouldn�t be taken as an encouraging precedent for workers in other sectors who might think the government will back down in the face of economic demands�however justifiable they might be.

    Does IV want to change the format of the letter ? If so, modified letter from IV will be appreciated. I thank pani_6 and IV's effort to address the EB-3 situation. If necessary, IV can also arrange meeting with Department of State for discussion of EB-3 Visa allotment and delays. EB-3 situation is really dier. IV is requested to please arrange meeting with DOS.
